Private Area/Office Signs

Why are there “Private” signs on many of the rooms upstairs at St. Luke? We are creating areas for immigrants who may need a safe(r) space at St. Luke.

To protect our neighbors (and ourselves), everyone must know their rights. The sanctuary, garden court, and narthex are public areas and, as such, are accessible to law enforcement. However, immigration agents can only enter a private area if they have a judicial warrant (not an immigration warrant) or if they have your permission. This rule also applies to your home.

A judicial warrant must be:

  • signed by a judge and

  • say “U.S. District Court” or a state court at the top.

Without a judicial warrant, ICE agents need your permission to enter private areas of your church.

If ICE agents attempt to enter a private area, say, “This is a private area. You cannot enter without a judicial warrant signed by a judge. Do you have a judicial warrant?” If they say they have a judicial warrant, ask to see it and read it. Do not use force to prevent ICE agents from entering if they refuse.

Sometimes, ICE agents try to use an administrative warrant to enter. But an administrative warrant does not give agents the right to enter private areas without your permission. Administrative warrants are not issued by a court. They display “Department of Homeland Security” and are Forms I-200 or I-205.
